Welcome to My AI Girlfriend ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application (the "App") and the services we provide through it. By creating an account or by using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the App.
By accessing and using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
You must be at least 18 years of age to access or use the App.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to terminate your account and your access to the App without notice for a violation of these user conduct guidelines.
Certain features of the App may be available only through a paid subscription. If you choose to subscribe, you agree to the subscription terms and pricing as presented to you at the time of purchase. Subscriptions may be offered on a monthly, weekly, or yearly basis, as specified within the App. All payments are handled by the respective app stores (Apple App Store or Google Play Store), and are subject to their terms and conditions.
Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions and turn off auto-renewal by going to your Account Settings in the respective app store after purchase.
To ensure a high quality of service for all users and to prevent abuse, we implement certain usage limits and a fair use policy.
Users on the free tier may be subject to daily limits on the number of messages, minutes for voice chats. These limits are subject to change at our sole discretion and will be communicated within the App.
Subscribed users benefit from significantly higher usage allowances. However, all usage on paid tiers is subject to a fair use policy to prevent unreasonable or excessive consumption of resources that could negatively impact the service for other users. "Fair use" means using the App for its intended purpose of personal entertainment and companionship, without engaging in automated, excessive, or otherwise abnormal usage patterns.

We monitor usage patterns and reserve the right to temporarily limit or suspend accounts that, in our sole discretion, are found to be in violation of this fair use policy, even if specific numerical limits have not been explicitly reached. We will generally attempt to notify you if your usage is deemed excessive before taking action. Continued excessive or unreasonable usage after such notification may lead to permanent suspension of your account.
The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Octane Software Solutions Ltd and its licensors. The App is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Octane Software Solutions Ltd.
You are solely responsible for the text that you create/share while using the App ("User Content"). You retain ownership of your User Content. However, by submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and our (and our successors' and affiliates') business, including for promoting and redistributing part or all of the Service.
The App integrates with and uses third-party services to provide its functionality. These services include, but are not limited to, Unity Technologies (for the game engine, user authentication, analytics, and crash reporting) and Microsoft Azure Cognitive Services (for AI chat functionalities, speech-to-text, and text-to-speech). Your use of the App also constitutes acceptance of the terms and privacy policies of these third-party services. We are not responsible for the practices of these third-party services.
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the App is at your sole risk. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Octane Software Solutions Ltd, its subsidiaries, affiliates, and its licensors do not warrant that a) the App will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the App is free of viruses or other harmful components; or d) the results of using the App will meet your requirements.
In no event shall Octane Software Solutions Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You agree to defend, indemnify, and hold harmless Octane Software Solutions Ltd and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the App.
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
